Terms and conditions

1. Object

Inserra Fabrizio (hereinafter, BikeShuttle.me) has developed a booking platform for mechanized lifts with vehicles (Shuttles), accessible from the website at www.bikeshuttle.me or as an application for mobile devices, designed to put in contact drivers (Shuttles) who offer a trip to a specific destination with passengers (bikers) who try to arrive at the same destination, in order to allow them to make the most of the free seats on the vehicles and donate a percentage of the service for maintenance / arrangement of the local trail network (hereinafter, the "Platform").
The present general conditions of use are intended to govern access and the conditions of use of the Platform. Please read them carefully.
The User acknowledges and accepts that Bikeshuttle.me is not a party to any agreement, contract or contractual relationship of any nature concluded between the Users of its Platform and therefore does not assume any responsibility in relation to the conditions, methods and timing with the which transport will be carried out by the driver, association or shuttle company.
BikeShuttle.me does not provide transport or logistic services nor does it operate as a transport carrier and that all such transport or logistics services are provided by third-party independent suppliers who are not employed by BikeShuttle.me.
By clicking on "Sign up with Facebook" or in any other way that allows you to subscribe to the Platform, the User acknowledges having read and accepted all these general terms and conditions of use.
Registration is free for all Users: Drivers and Passengers

2. Definitions

In this document,

"Account" means the account that must be created to become a User and access certain services offered by the Platform;

"Facebook Account" assumes the meaning indicated in the following Article 3.2;

"BikeShuttle.me" assumes the meaning indicated in Article 1 above;

"Announcement" means an announcement on a Trip published on the Platform by a Driver;

"General terms and conditions of use" means these general terms and conditions of use;

"Driver" means the Shuttle user who uses the Platform to offer to transport another person in exchange for a service contribution, for a transport and at a time defined only by the shuttle;

"User profile" means the summary of Passenger reservations, confirmed in Green, waiting for the minimum number to start in Yellow, canceled in Red;

"Booking Confirmation" takes on the meaning indicated in the following Article 4.2.1;

"User Content" assumes the meaning indicated in the following Article 11.2;

"Shuttle service fee" means, for a given Trip, the sum of money requested by the driver and accepted by the passenger as consideration for the journey;

"Platform service cost" assumes the meaning indicated in the following Article 5.3.2;

"Donation Trails" assumes the meaning indicated in the following Article 5.3.3;

"Passenger" means the Biker User with bike following the acceptance of the offer to be transported by the Driver or, where applicable, the person on whose behalf a User has booked a Seat;

"Seat"  means the seat booked by a Passenger in the driver's vehicle;

"Platform" takes on the meaning indicated in Article 1 above;

"Services" means all the services provided by BikeShuttle.me offered through the Platform;

"Website" means the website accessible at www.bikeshuttle.me;

"Treats" takes on the meaning indicated in the following Article 4.1;

"User" means any person who has created an Account on the Platform;

"Journey / Tour" means the journey that is the subject of an Announcement published by a Driver on the Platform and in relation to which he agrees to carry Passengers in exchange for a Shuttle Service Fee;
 

3. Registration on the platform and creation of an account

3.1. Conditions of registration on the Platform

Registration is free for all Users: Drivers and Passengers
The Platform can be used by people aged 18 or over. Registration on the platform of a minor is strictly prohibited.
By accessing, using or registering on the Platform, the User declares and guarantees to be 18 years old.

3.2. Creating an account

The Platform allows Users to send and view announcements and interact with each other to book a seat. You can view the ads if you are not registered on the Platform. However, it is not possible to post an ad or reserve a seat without first creating an account and becoming a user.
To create the account, you can:
(i) complete all mandatory fields on the registration form;
(ii) or log in to your Facebook account through our Platform (hereinafter, "Facebook Account"). By using this functionality, the User understands and accepts that Bikeshuttle.me will have access, will publish on the Platform and will retain some information acquired by the Facebook Account. You can delete the link between your account and the Facebook account at any time through the "Checks" section of the profile. To register on the Platform, you must have read and accepted these General Terms and Conditions of Use and the Privacy Policy

When creating the Account, regardless of the method chosen, the User agrees to provide accurate and truthful information, and to update it from his profile or by informing Bikeshuttle.me, in order to ensure its relevance and accuracy for the duration of the his contractual relations with Bikeshuttle.me
In the case of registration by e-mail, the User agrees to keep the password chosen when the Account was created and not to disclose it to anyone. If the User loses or reveals his password, the User agrees to immediately inform Bikeshuttle.me. Only the User is responsible for the use of the Account by third parties, unless he has expressly informed Bikeshuttle.me of the loss, the fraudulent use by third parties or the disclosure of his password to third parties.
The User undertakes not to create or use, under his own identity or that of a third party, accounts other than the one initially created.

3.3. Check

Bikeshuttle.me can, for the purpose of transparency, to increase security or prevent or detect fraud, set up a system to verify some of the information provided on the profile. This is particularly true when the User enters the telephone number or provides an identification document.
The User acknowledges and accepts that any reference on the Platform or on the Services to "verified" information, or any similar term, only means that a User has successfully passed the verification procedure existing on the Platform or the Services in order to provide further information relating to the User with whom you are considering traveling. Bikeshuttle.me cannot guarantee the truthfulness, reliability or validity of the information subject to the verification procedure.
 

4. Use of services

4.1. Announcement publication

As a User and as long as the following conditions are met, it is possible to create and publish Ads on the Platform by entering information on the Trip you intend to do (dates / times and collection and arrival points, number of seats offered, options available, amount of the Fee to the shuttle service etc.).
When publishing the Announcement, it is possible to indicate the type of Travel / Tour, Routes, in which the Driver accepts to stop, to pick up or drop off the Passengers.
The User is authorized to publish an announcement only if all the following conditions are met:
- (i) a valid driving license of type B or equivalent foreign license is in possession;
- (ii) publishes Ads only for vehicles that it owns or uses with the express permission of the owner, and in all cases that its use for bike shuttling is not prohibited. In particular, compliance with the regulations on the subject and the required authorizations (NCC Licenses, Amateur Sports Associations, etc.) is required in order to carry out the main Bike Shuttling services such as: "Single Ascent with or without a guide" and / or "Full Days" with or without Guide ".
- (iii) the User may not be the main driver of the vehicle being advertised;
- (iv) the vehicle has valid third-party insurance;
- (v) there is no contraindication or incapacity of a medical nature to driving;
- (vi) the vehicle intended for travel is a vehicle with at least 4 wheels;
- (vii) the User does not intend to publish another announcement for the same trip on the Platform;
- (viii) the User does not offer more seats than the number available in the vehicle;
- (ix) all offered seats are fitted with a safety belt, even if the vehicle is approved with seats without a safety belt;
- (x) the User uses a vehicle in good condition and complies with the provisions of the law and applicable customs, in particular with an updated revision.
The User acknowledges that he is solely responsible for the content of the announcement published on the Platform. Consequently, the User declares and guarantees the accuracy and truthfulness of all the information contained in the announcement and undertakes to conduct the trip in accordance with the conditions described in the announcement.
If the Announcement complies with the General Terms and Conditions of Use, it will be published on the Platform and therefore visible to Users and to all visitors, even non-users, who carry out a search on the Platform or on the Bikeshuttle.me website.
Bikeshuttle.me reserves the right, at its sole discretion and without notice, not to publish or remove, at any time, any ad that does not comply with the general terms and conditions of use or that it considers to be harmful to its image, that of the Platform or that of the Services.
The User acknowledges and accepts that the criteria taken into consideration for the classification and order of display of the Announcement among the other Announcements are at the sole discretion of Bikeshuttle.me

4.2. Seat reservation

4.2.1. Booking procedure

Bikeshuttle.me has set up an online booking system for seats offered on the Platform.
When a passenger is interested in an announcement, he can make the reservation by paying online for the cost of the platform service and the donation of the paths. Shuttles in red have not yet reached the minimum number required by the driver to leave and therefore the service is not guaranteed until the minimum number of passengers is reached; Those in green, on the other hand, have already reached the minimum number to leave and therefore after the platform's automatic validation of the booking, the Passenger and the driver receive a booking confirmation via email (the "Booking Confirmation").
If the Driver does not reach the minimum number of passengers (visible in the details of the trip) to guarantee the service, the platform no. Hours before departure will automatically send a cancellation email to Driver and Passenger, reimbursing the Cost within 24/48 hours of platform service and donation paths paid in advance.
Upon confirmation of the reservation, Bikeshuttle.me will send the passenger the driver's phone number (if the user is the passenger) or of the Passenger (if the user is the driver). The User is the only responsible for the fulfillment of the contract that binds him to the other user.

In the User Profile section, the passenger can check the status of his reservations and change them.

4.2.2. Nature of seat reservation and terms of use of the Services on behalf of third parties

In principle, each user should book their own seat. However, Bikeshuttle.me allows its Users to book one or more Seats on behalf of third parties. In this case, the User who books the place undertakes to indicate precisely to the driver, at the time of booking, the contact of the persons on behalf of whom the seat (s) have been booked.
It is strictly forbidden to reserve a place for a minor under the age of 14 who is traveling alone. In the event that you are booking a place for a minor over the age of 14 traveling alone, the User undertakes to request the preliminary agreement of the Shuttle and to provide him with a duly completed and signed authorization from his legal guardians.
Furthermore, the Platform is intended for seat reservations for natural persons. It is forbidden to reserve a place for the transport of any object, package, animal that travels alone or objects of any type.
Furthermore, it is forbidden to publish an Announcement for a Driver other than a User.
 
4.3. Review system

4.3.1. Operation

Bikeshuttle.me encourages the user to leave feedback on the treatment provided by a Driver. However, it is not permitted to leave feedback on another Passenger if the User was a Passenger or a Driver with whom he / she did not travel or with whom no Journey was planned.

4.3.2. Moderation

You acknowledge and agree that Bikeshuttle.me reserves the right not to publish or delete any feedback, question, comment or response if it believes that its content violates these General Terms of Use.

4.3.3. Limit

Bikeshuttle.me reserves the right to suspend the Account, restrict access to the Services or terminate these General Terms of Use if (i) it has received at least three feedbacks and (ii) the average feedback received is less or equal to 3.

5. Financial conditions

5.1. Fee for the Shuttle service

The shuttle service fee is determined by the User, as Driver, under his sole responsibility.
Consequently, the Driver agrees that the platform applies to the Shuttle Service Fee the Platform service cost and the Donation paths paid in advance online by the Passenger.

5.2. Rounding

The User acknowledges and accepts that Bikeshuttle.me may, in its sole discretion, round up or down the cost of the service.

5.3 Payment methods for the Shuttle service fee

The User, Driver, has the option of being paid the Corresponding shuttle service by Passengers, opting for a payment by credit card or cash paid directly before leaving (see 5.3.1).

5.3.1. Payment by car

If the Driver chooses to be paid by card or cash in the car, the User, Passenger, undertakes to pay the fee for the shuttle service to the Driver at the time of boarding.

5.3.2 Payment Cost of the platform service

The cost of the platform service is determined by the Bikeshuttle.me platform, under its sole responsibility.
Designates the value of the commission that holds BikeShuttle.me from the Passenger as a percentage of the Shuttle service fee from a minimum of 5% to a maximum of 18%.
Consequently, the Driver and the Passenger agree that the platform will apply to the Shuttle Service Fee the platform service Cost and the Donation paths paid in advance online by the Passenger.

5.3.3 Donation trails

The Donation Trails is determined by the Bikeshuttle.me Platform, under its sole responsibility.
Designates the value of the commission that retains BikeShuttle.me from the Passenger as a percentage of the Shuttle service fee, corresponding to 5%, which is donated to the association or local authority for maintenance of the trail network.
Consequently, the Driver and the Passenger agree that the platform will apply to the Shuttle Service Fee the platform service Cost and the Donation paths paid in advance online by the Passenger.
 

6. Cancellation policy

6.1. Refund conditions in the event of cancellation by the Passenger

Travel / Tours are subject to the cancellation policy described below.
In case of cancellation of the Passenger:

SINGLE LIFT
If the Passenger cancels with more than 48 hours notice (2 days) before the scheduled departure time, as indicated in the announcement, the Passenger will be reimbursed for the entire sum paid online within 24/48 hours (Platform service cost and the Donation paths)

WHOLE DAY
If the Passenger cancels 120 hours (5 days) before the scheduled departure time, as indicated in the announcement, the Passenger will be reimbursed for the entire amount paid online within 24/48 hours (Cost of platform service and Donation of trails)

If the Passenger cancels beyond the terms described above or does not show up at the meeting no later than 15 minutes after the agreed time, the reservation is no longer refundable (Cost of platform service and donation of paths);

When a Passenger cancels before departure, the canceled seat or places will automatically be made available to other passengers, who can book online and are therefore subject to the conditions of these General Terms and Conditions of Use.
BikeShuttle.me evaluates, in its sole discretion, based on the information available, the legitimacy of the reimbursement requests.

6.2. Refund conditions in the event of cancellation by the driver

Travel / Tours are subject to the cancellation policy described below.
In case of cancellation by the Driver, the Passenger is reimbursed in any case for the entire sum paid online within 24/48 hours (Cost of platform service and Donation of trails).
This is particularly true when the Driver cancels a trip or has not presented himself within 15 minutes after the agreed time;
In case of cancellation the Driver is obliged to contact the Passenger and the BikeShuttle.me customer service communicating the impossibility to carry out the service. It will also undertake to find an alternative solution of equal service without additional costs.
 

7. Behavior of the users of the Platform

7.1. Commitment of all users of the Platform

The User (Driver or Passenger) acknowledges being the only person responsible for compliance with all laws, regulations and obligations applicable to the use of the Platform.
Moreover, when using the Platform and during the Travels, the Engagement User:
(i) not to use the Bikeshuttle.me Platform for illicit and fraudulent purposes
(ii) not to send false, misleading, harmful or fraudulent information to BikeShuttle.me (in particular when the account is created or updated) or to other Users;
(iii) not to speak or behave in any way or to publish any content on the Platform of a defamatory, abusive, obscene, pornographic, vulgar, offensive, inappropriate, violent, threatening, harassing, racist or xenophobic or sexual nature, which contains incitement to violence, discrimination or hatred, activities that encourage or use illegal substances, or more in general contrary to the purposes of the Platform, which could violate the rights of BikeShuttle.me or a third party or that is contrary to good costume and / or public order;
(iv) not to infringe the rights and image of BikeShuttle.me, in particular its intellectual property rights;
(v) not to open more than one account on the Platform and not to open an account on behalf of third parties;
(vi) not to attempt to bypass the Platform's reservation system, in particular by attempting to send another User their contact details in order to make a booking outside of the Platform and to avoid paying the platform service Cost and Donation paths provided by BikeShuttle.me;
(vii) not to contact another User, in particular via the Platform, for a purpose other than that which defines the terms of the bike shuttling Service;
(viii) not to accept or pay outside the Platform, except in the cases authorized by these General Terms of Use;
(ix) to comply with these general terms and conditions of use and the privacy policy.

7.2 Engagement of drivers

Furthermore, when using the Platform as a Driver, you commit yourself:
(i) to comply with all laws, regulations and codes applicable to driving and the vehicle, in particular to hold civil liability insurance valid at the time of travel and to be in possession of a valid driving license;
(ii) to check that the insurance covers the Shuttle service and that the Passengers are considered as third parties in the vehicle and are therefore covered by insurance;
(iii) not to take any risk while driving, not to take any substance that could endanger the attention and ability to drive carefully and in complete safety
(iv) to publish announcements corresponding to trips / tours actually scheduled;
(v) to conduct the trip as described in the announcement and to respect the times and places agreed with the other Users (in particular the place of meeting and unloading);
(vi) not to take more Passengers than the number of Seats indicated in the announcement;
(vii) to use a vehicle in good condition and in compliance with the provisions of law and applicable customs, in particular with an updated revision;
(viii) to notify BikeShuttle.me or any passenger who so requests a driving license, car registration certificate, insurance certificate, revision and any document demonstrating the User's ability to use the vehicle as a Driver on the Platform;
(ix) in case of delay or change of times or travel, inform the Passengers without delay;
(x) in the case of a cross-border voyage, to possess and keep at the disposal of the Passenger and the authorities that could request it any document certifying his identity and the right to cross the border;
(xi) to wait for Passengers at the agreed meeting point for at least 15 minutes after the agreed time;
(xii) not to publish an advertisement relating to a vehicle that you do not own or that you are not authorized to use for bike shuttling;
In particular, compliance with the regulations on the subject and the required authorizations (NCC Licenses, Amateur Sports Associations, etc.) is required in order to carry out the main Bike Shuttling services such as: "Single Ascent with or without a guide" and / or "Full Days" with or without Guide ".
(xiii) to make sure you can be contacted by Passengers by telephone at the number registered on the profile;
(xiv) to have no contraindication or incapacity of a medical nature that prevents driving;
(xv) to behave correctly and responsibly during the journey and in accordance with the spirit of the bike shuttling.

7.3 Passenger commitments

When using the Platform as a Passenger, you undertake:
(i) to behave appropriately during the journey so as not to hinder the concentration or guidance of the Driver or the tranquility of the other Passengers;
(ii) to respect the driver's vehicle and its cleanliness;
(iii) in case of delays, to inform the Driver without delay;
(iv) to pay the agreed service fee to the Driver;
(v) to wait for the Driver at the meeting point for at least 15 minutes after the agreed time;
(vi) to communicate to BikeShuttle.me or to any Driver who requests it, their identity card or a document certifying their identity;
(vii) not to carry during a journey any substance or animals that could hinder the driving and concentration of the Driver, or the nature, possession or transport of which is in conflict with the provisions of the law in force;
(viii) in the case of a cross-border journey, to possess and keep at the disposal of the Driver and the authorities that may request it any document certifying his identity and the right to cross the border;
(ix) to make sure that you can be contacted by the Tenant by telephone at the number registered on the profile, including at the meeting point.

In the event that the User has made a reservation for one or more seats on behalf of third parties, in accordance with the provisions of these General Terms and Conditions of Use, the User ensures compliance by such third parties with the provisions of this article, and in general of these General Terms and Conditions of Use. BikeShuttle.me reserves the right to suspend the account, restrict access to the Services or terminate these General Terms and Conditions of Use in the event of a breach by third parties on whose behalf the User has booked a place pursuant to these Conditions general terms of use.


8. Account suspension, access limitation and termination

The User can interrupt his contractual relations with BikeShuttle.me at any time, without costs and without giving any reasons. To do this, simply go to the "Close my account" tab on the profile page.
In the event of (i) violation of these General Terms and Conditions of Use, including the obligations of the Users referred to in Articles 6 and 8 above, (ii) exceeding the limit set out in Article 4.3.3 above, or (iii) if BikeShuttle .me has a real reason to believe that this is necessary to protect its security and its integrity, that of the Users or third parties, or for the purpose of preventing fraud or investigations, BikeShuttle.me reserves the right to:
(i) terminate the general terms and conditions of use which bind the User to BikeShuttle.me immediately and without notice; and / or
(ii) prevent the publication or remove any feedback, announcement, content, booking request, or any content published by the User on the Platform; and / or
(iii) limit the access and use of the Platform by the User; and / or
(iv) temporarily or permanently suspend the account.

When this proves necessary, the User will be informed of the application of this measure in order to allow him to provide explanations to BikeShuttle.me.
BikeShuttle.me will decide, at its sole discretion, whether to remove the applied measures.

9. Personal data

In the context of the use of the Platform by the User, BikeShuttle.me will collect and process the personal data supplied by the User. By using the Platform and registering as a User, the User recognizes and accepts the processing of his personal data by BikeShuttle.me in compliance with current legislation and the provisions of the privacy statement.

10. Intellectual property

10.1. Content published by BikeShuttle.me

In relation to the content provided by its Users, BikeShuttle.me is the sole holder of all intellectual property rights relating to the Platform, its content (in particular texts, images, drawings, logos, videos, sounds, data, graphics) and the software and databases that ensure its functioning.
BikeShuttle.me grants you a non-exclusive, personal and non-transferable right to use the Platform, for personal and private use, on a commercial basis and in accordance with the purposes of the Platform and Services.
Any other use or exploitation of the Platform, and its contents, without the prior written permission of BikeShuttle.me is prohibited. In particular, the User is prohibited:
(i) reproduce, modify, adapt, distribute, represent and publicly disseminate the Platform and the content, with the exception of what is expressly authorized by BikeShuttle.me;
(ii) decompile and apply reverse engineering to the Platform, subject to the exceptions provided by the texts in force
(iii) extract or attempt to extract (in particular by using robots for data mining or any other similar data collection tool) a substantial part of the Platform data.

10.2. Content published by the User on the Platform

In order to allow the provision of the Services, and in accordance with the objective of the Platform, the User grants BikeShuttle.me a non-exclusive license to use the content and data provided in the context of the use by the User of the Services (hereinafter, "User Content"). To allow BikeShuttle.me to distribute via the digital network and in compliance with any communication protocol (in particular the Internet and mobile network), and to provide the content of the Platform to the public, the User authorizes BikeShuttle.me, throughout the world and for the entire duration of its contractual relationships with BikeShuttle.me, to reproduce, represent, adapt and translate the User Content as follows:
(i) the User authorizes BikeShuttle.me to reproduce all or part of the User Content on any digital recording medium, known or still unknown, and in particular on any server, hard disk, memory card, or any other support equivalent, in any format and with any procedure, known or still unknown, to the extent necessary for any filing, backup, transmission or download related to the operation of the Platform and the provision of the Service;
(ii) the User authorizes BikeShuttle.me to adapt and translate the User Content, and to reproduce these adaptations on any digital medium, current or future, as indicated in point (i) above, with the aim of providing the Services, in particular in different languages. This right includes in particular the possibility of making changes to the formatting of the User Content, with respect for its moral right, for the purposes of complying with the graphic layout of the Platform and / or making it technically compatible with a view to its publication through the Platform.
 

11. Role of BikeShuttle.me

The Platform is an online networking platform where Users can create and publish Travel Ads for Bike Shuttling purposes. Such Ads may in particular be viewed by other Users in order to know the conditions of the Trip and, where applicable, to directly book a Seat in the vehicle in question with the User who published the Announcement on the Platform.
By using the platform and accepting these General terms and conditions of use, the User acknowledges that BikeShuttle.me is not a party to any agreement between the User and other Users and therefore does not assume any responsibility in relation to the conditions, methods and timing with which the transport will be carried out by the driver, association or shuttle company.
BikeShuttle.me has no control over the behavior of its Users and Platform users. Does not own, exploit, supply or manage the vehicles covered by the Announcements and does not offer any Travel on the Platform.
The User recognizes and accepts that BikeShuttle.me does not check the validity, truthfulness or legality of the Announcements, Places and Travels offered. As a Bike Shuttling intermediary, BikeShuttle.me does not provide any transport services and does not act as a carrier; the role of BikeShuttle.me is limited to facilitating access to the Platform.
Users (Drivers or Passengers) act under their exclusive and full responsibility.
As an intermediary, BikeShuttle.me cannot be held responsible for the actual occurrence of a trip, and in particular due to:
(i) incorrect information communicated by the Driver about his Announcement, or by any other means, regarding the Journey and its conditions;
(ii) cancellation or modification of a Trip by a User;
(iii) failure to pay the Shuttle Service Fee;
(iv) behavior of its Users during, before or after the Journey.
 

12. Operation, availability and functionality of the Platform

BikeShuttle.me will try as far as possible to keep the Platform accessible 7 days a week and 24 hours a day. However, access to the Platform may be temporarily suspended, without notice, due to technical maintenance, migration or updating, or due to interruptions or limitations linked to the functioning of the network.
Furthermore, BikeShuttle.me reserves the right to modify or suspend access to the Platform or its functions, in its sole discretion, temporarily or permanently, in whole or in part.
 

13. Changes to the general terms and conditions of use

These general terms and conditions of use and the integrated documents by reference represent the entire agreement between the User and BikeShuttle.me concerning the use of the Services. Any other document, in particular any mention relating to the Platform (FAQ etc.), has the sole purpose of providing indications.
BikeShuttle.me may modify these General Terms and Conditions of Use in order to adapt them to its technological and commercial environment and to comply with the legislation in force. Any changes to these General Terms and Conditions of Use will be published on the Platform indicating the effective date and the User will be notified by BikeShuttle.me before it enters into force.

14. Applicable law - Disputes

These general terms and conditions of use are written in Italian and subject to Italian law. The User is required, prior to any request for mediation, to have informed BikeShuttle.me of any disputes in writing in order to obtain a friendly solution.

15. Legal notes
